Trademark Conflict Search
$250 Flat Rate
Mastermark will perform a comprehensive search of the USPTO database and internet for any conflicting trademarks that may prevent your trademark from becoming registered. Thereafter, you will be provided with a detailed report and opinion of the results. If the results are unfavorable, Mastermark will perform an additional "free" search for an alternative trademark.
*It is required that Mastermark performs a conflict search prior to filing a trademark application on your behalf.
Trademark Applications
$1000 Flat Rate
I. "Actual Use” Application - Attorney will prepare and file a USPTO trademark application for those who have a trademark that they are currently using "in commerce." Additionally, attorney will correspond with the USPTO's examining attorney and address any Office Actions that might be issued concerning the application.
*$1000 Flat Rate plus the $250 USPTO filing fee. In the event that an Office Action is issued and the reply requires "substantial" legal work, we reserve the right to bill an additional fee of $250.
II. "Intent To Use” Application - Attorney will prepare and file a USPTO trademark application for those who have a trademark that they intend to use "in commerce" at a future date. Additionally, attorney will correspond with the USPTO's examining attorney and address any Office Actions that might be issued concerning the application.
*$1000 Flat Rate plus the $250 USPTO filing fee. In the event that an Office Action is issued and the reply requires "substantial" legal work, we reserve the right to bill an additional fee of $250.
Please Note: If the USPTO ultimately approves the "Intent To Use" application and a "Notice Of Allowance" is issued, then a “Statement Of Use” (demonstrating that the applicant is now using the trademark "in commerce") must be filed within six months to obtain a registration. If the applicant, is not using the trademark by the end of this six month period, then the applicant may file an extension to file the Statement of Use at a later date.
*$300 Flat Rate for "Statement Of Use" plus the $100 USPTO filing fee.
*$200 Flat Rate for an extension to file a "Statement Of Use" plus the $125 USPTO filing fee.
Trademark Renewals
Starting at $1000
I. "Section 8 Declaration" (5-Year Renewal) - Between the 5th and 6th year of registration a trademark must be renewed for an additional 5-year period by filing a Section 8 Declaration. If a Section 8 Declaration is not filed by the relevant deadline, the registration will expire and become “DEAD.”
*$1000 Flat Rate plus the $225 USPTO filing fee.
II. "Section 8 Declaration & Section 9 Renewal" (10-Year Renewal) - Between the 9th and 10th year of registration, a trademark must be renewed for an additional 10-year period. If a Section 8 Declaration is not filed along with a Section 9 Renewal by the relevant deadline, the registration will expire and become “DEAD.”
*$1200 Flat Rate plus the $525 USPTO filing fee.
Trademark Assignments
$500 Flat Rate
Attorney will draft and file a trademark assignment for parties interested in transferring ownership of their registered trademark to another party (individual or business entity).
*$500 Flat Rate plus the $40 USPTO filing fee.
