Trademark Clearance Search
$300 Flat Fee
Mastermark will perform a comprehensive search of the USPTO database and internet for any conflicting trademarks (both Federal and Common Law) that may prevent your trademark from becoming registered. Thereafter, you will be provided with a detailed report and opinion of the results. If the results are unfavorable, Mastermark will perform a complimentary search for an alternative trademark.
Trademark Applications
$1200 Flat Fee
I. "Actual Use” Application - Attorney will prepare and file a USPTO trademark application for those who have a trademark that they are currently using "in commerce." Additionally, attorney will correspond with the USPTO's examining attorney and address any Office Actions that might be issued concerning the application.
*$1200 Flat Fee (includes $350 USPTO filing fee). In the event that an Office Action is issued and the reply requires "substantial" legal work, Mastermark reserves the right to bill an additional fee of $250.
II. "Intent To Use” Application - Attorney will prepare and file a USPTO trademark application for those who have a trademark that they intend to use "in commerce" at a future date. Additionally, attorney will correspond with the USPTO's examining attorney and address any Office Actions that might be issued concerning the application.
*$1200 Flat Fee (includes the $350 USPTO filing fee). In the event that an Office Action is issued and the reply requires "substantial" legal work, Mastermark reserves the right to bill an additional fee of $250.
Please Note: If the USPTO ultimately approves the "Intent To Use" application and a "Notice of Allowance" is issued, then a “Statement of Use” (demonstrating that the applicant is now using the trademark "in commerce") must be filed within six months to obtain a registration. If the applicant, is not using the trademark by the end of this six month period, then the applicant may file an extension to file the Statement of Use at a later date.
*$400 Flat Fee for "Statement of Use" (includes $150 USPTO filing fee).
*$250 Flat Fee for an extension to file a "Statement of Use" (includes $125 USPTO filing fee).
Trademark Renewals
$850-$1200 Flat Fee
I. "Section 8 Declaration" (5-Year Renewal) - Between the 5th and 6th year of registration a trademark must be renewed for an additional 5-year period by filing a Section 8 Declaration. If a Section 8 Declaration is not filed by the relevant deadline, the registration will expire and become “DEAD.”
*$850 Flat Fee (includes $325 USPTO filing fee).
II. "Section 8 Declaration & Section 9 Renewal" (10-Year Renewal) - Between the 9th and 10th year of registration, a trademark must be renewed for an additional 10-year period. If a Section 8 Declaration is not filed along with a Section 9 Renewal by the relevant deadline, the registration will expire and become “DEAD.”
*$1200 Flat Fee (includes $650 USPTO filing fee).
Attorney will draft and file a trademark assignment for parties interested in transferring ownership of their registered trademark to another party (individual or business entity).
*$500 Flat Fee (includes USPTO filing fee).
